Terms and Conditions

These Terms of Service constitute a legally binding agreement between you and us (Mobile Locksmith Tucson) regarding your access to and use of our website mobilelocksmithtucson.com (referred to as "Website" thereinafter) and our online and in-person services. By accessing or using our Website, online and in-person services, you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, please do not use our Website or services.

Article I – General Use of Website and Services

Section I – Intellectual Property Rights

Unless otherwise indicated, the Website is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Website (collectively, the “Content”) and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

Section II – User Representations

By using the Website, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.

  • You will maintain the accuracy of such information and promptly update such registration information as necessary.

  • You have the legal capacity and you agree to comply with these Terms of Service.

Section III – Prohibited Activities

You may not access or use the Website for any purpose other than that for which we make the Website available. The Website may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Section IV – User Generated Contributions

We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Website, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). 

Section V – Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Website at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Website.

Section VI – Governing Law

These Terms of Service and your use of the Website and all our online and in-person services are governed by and construed in accordance with the laws of the State of Arizona applicable to agreements made and to be entirely performed within the State of Arizona, without regard to its conflict of law principles.

Article II – In-Person Locksmith Services

Section I – Service Provision

When you request in-person from us, we agree to provide professional locksmith services at your location. Services may include lock installation, repair, rekeying, emergency lockout assistance, and other related services as requested.

Section II – Scheduling and Appointments

Appointments for in-person services can be scheduled through our website, phone, but not email as email correspondence is not immediate. We will make every effort to arrive at the scheduled time, but we cannot guarantee punctuality due to traffic, weather conditions, or other unforeseen circumstances. We will notify you as soon as possible if there will be a significant delay.

Section III – Customer Responsibilities

  • Access: You must ensure that our locksmiths can safely and lawfully access the property and the specific areas where services are to be performed. (Example: if this property is located inside a gated community, you must give permission for the locksmith to enter the premise)

  • Authorization: You represent that you have the legal right to authorize our locksmiths to perform services on the property.

  • Environment: Ensure that the work environment is safe and free from hazards for our technicians.

Section IV – Pricing and Payment

  • Estimates: We provide estimates based on the information you provide. Final costs may vary if additional services are required or if the scope of work changes. We try our best to stick to the initial quote, but further assistance deemed necessary by the nature of circumstances may incur further costs. 

  • Documentation: All prices must be communicated, agree upon, and documented prior to the performance of service. An invoice/receipt may be provided with a physical note or digitally.

  • Payment: Payment is due upon completion of the services unless otherwise agreed upon in writing. We accept only cash, credit cards, and debit cards. Cheques are not accepted.

  • Credit Card Processing Fee: A one-time 2.5% processing fee may apply if you choose to pay with a credit card, whether through Apple Pay, a physical credit card, or manual entry of credit card information. Our technician has the discretion to waive this fee. We reserve the right to deny payments using American Express or other brands of payments in case of a change in processing fee. 

Section V – Cancellation and Rescheduling

At Mobile Locksmith Tucson, we seek to provide you the best service with the lowest risk. Therefore, unless otherwise agreed upon, all service requests are without cancellation fee on the customer's front. ​

Section VI – Warranties and Guarantees

  • Service Guarantee: We guarantee our workmanship for a period of 30 days from the date of service. If you experience any issues related to our work within this period, please contact us, and we will address the issue at no additional charge.

  • Product Warranty: Warranties are subject to the specific product. Speak to your technician if anything occurs. 

Section VII – Liabilities

You must provide valid proof of ownership or the right to the property where the locksmith services are requested. If the proof provided is found to be invalid at the scene, your service will be refused. And if the proof provided is found to be invalid after the service is provided, you will be held fully responsible for any consequences arising from the unauthorized service, including but not limited to legal actions and damages.

​To the maximum extent permitted by law, Kallos Design and Marketing, doing business as Mobile Locksmith Tucson, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Furthermore, any liabilities arising from the actions of our 1099 contractors will be the responsibility of the contractor's respective LLC. Kallos Design and Marketing shall not be held liable for the actions or omissions of its contractors.

Section VIII – Dispute Resolution

Any disputes arising from or related to in-person locksmith services will be resolved in accordance with the dispute resolution terms set forth in our general Terms of Service. Legal actions must be filed in the state and federal courts located in Pim County, Arizona.

Section IX – Fair Use

All trademarks, logos, and assets on this website that are not the property of Mobile Locksmith Tucson are used for identification and informational purposes only. They remain the property of their respective owners. Mobile Locksmith Tucson claims no ownership and is not endorsed by or affiliated with these entities. Section X – DBA Disclosure

Kallos Design and Marketing LLC, doing business as Mobile Locksmith Tucson, is a legally distinct entity from Mobile Locksmith Tucson LLC. Any reference to Mobile Locksmith Tucson within this document pertains to the business operations conducted under the DBA Mobile Locksmith Tucson and not the LLC by the same name. This distinction is made to clarify the separate operational roles and responsibilities held by the DBA and the LLC under the same parent entity.
